These Terms set out the agreement between the user and us for using our website and for any purchases you make from us through https://emporentia.com/.

Please read these Terms and Conditions carefully before using our website or placing an order. By using our website, creating an account or placing an order, you agree to be bound by these Terms and Conditions.

If you do not agree to these Terms and Conditions, you should not use our website or place an order with us.

Nothing in these Terms and Conditions affects your statutory rights as a consumer.

We may also sell products through our seller accounts on Amazon, eBay and TikTok Shop. If you purchase from us through Amazon, eBay or TikTok Shop, the terms, policies and dispute processes of that platform may also apply. These terms apply mainly to purchases made directly through our website unless we state otherwise.

If there is any conflict between these terms and a specific policy, promotion term, product-specific term, payment-provider term or platform term, the more specific term will apply to that particular issue.

Emporentia is an ecommerce retailer selling branded and general retail products.

Product categories may include, but are not limited to:

a.     perfumes and fragrances;

b.    beauty and personal care products;

c.     household products;

d.    fashion and accessories;

e.     gifts and lifestyle products; and

f.      other products listed on our website from time to time.

Product availability, brands, categories and ranges may change at any time.

Our website is not currently operated as a third-party seller marketplace. Independent third-party sellers do not list products on Emporentia.com and do not receive customer order details from us for fulfilment.

3.    Changes To These Terms And Conditions

We may update these Terms and Conditions from time to time to reflect changes in our business, products, website, payment providers, delivery providers, legal obligations or operational requirements.

The version of these Terms and Conditions that applies to your order will normally be the version published on our website at the time you place your order.

f.      we are required to do so by law, a payment provider, courier, platform, regulator or authority.

We will not use this section to remove or limit your statutory consumer rights.

8.1. Product Information

Product descriptions, images, ingredients, packaging details, usage information, warnings and specifications may be provided by manufacturers, suppliers, distributors or brands.

9.    Prices, VAT and Delivery Charges

Delivery charges are shown separately where applicable and may depend on delivery method, destination, order value, parcel weight, parcel size, courier service or product type.

Unless stated otherwise, promotions cannot be exchanged for cash and may not be used with other offers.

b.    minimum spend requirements;

We may cancel, reject or refuse to honour a promotion where we reasonably believe there has been fraud, misuse, technical error, unauthorised sharing, manipulation or breach of the promotion terms.

This section does not affect your statutory rights.

11.2.     Free Gifts, Bundles and Multibuy Offers

We may offer free gifts, bundles, multibuy offers or promotional items from time to time.

Free gifts and promotional items are subject to availability and may be substituted, withdrawn or changed where necessary.

Unless stated otherwise, free gifts have no cash alternative and cannot be purchased separately.

If you return a product that qualified you for a free gift, bundle discount or promotional item, you may be required to return the free gift or promotional item as well.

If the free gift or promotional item is not returned, we may reduce your refund by a reasonable amount reflecting the value of the unreturned item, where lawful and reasonable.

This section does not affect your statutory rights if the product is faulty, damaged, incorrectly supplied or not as described.

Gift cards, vouchers, and credits may be subject to additional terms, including expiry dates, usage restrictions, product exclusions, minimum spend requirements and non-transferability.

Gift cards, vouchers and credit cannot usually be exchanged for cash unless required by law.

We are not responsible for lost, stolen, deleted, misused or unauthorisedly used gift cards, vouchers or credit, unless caused by our failure to take reasonable care.

We may cancel or refuse gift cards, vouchers or credit where we reasonably suspect fraud, misuse, technical error or breach of applicable terms.

12.  Orders and Contract Formation

12.1.     Placing an Order

When you place an order, you are making an offer to buy the products in your basket.

You should check your order carefully before submitting it, including product details, quantity, delivery address, billing details, delivery method, payment method and total price.

f.      the order breaches these Terms or another policy;

g.    the order appears to be placed for unauthorised resale;

h.    age restrictions or legal restrictions apply;

i.      the order cannot be fulfilled safely or lawfully;

j.      courier, payment provider or platform restrictions apply; or

k.     we are required to do so by law, a regulator, court, authority, payment provider, courier or platform.

If we cancel an order after payment has been taken, we will refund the amount paid for the cancelled item or order.

12.4.     Order Changes Before Dispatch

Once an order has been placed, we may not be able to change or cancel it before dispatch because orders may be processed quickly.

If you need to change or cancel an order, contact us as soon as possible at support@emporentia.com.

We will try to help, but we cannot guarantee that changes or cancellations can be made before dispatch.

13.  Payment and Buy Now Pay Later

13.1.     Payment Methods

We may accept payment through payment methods and providers shown at checkout, including:

a.     Stripe;

b.    PayPal;

c.     Apple Pay, where available through our payment providers;

d.    Google Pay, where available through our payment providers;

e.     Clearpay;

f.      Klarna; and

g.    WooCommerce checkout and payment gateway integrations enabled on our website.

Available payment methods may change from time to time.

By placing an order, you confirm that you are authorised to use the payment method provided.

Your order may be subject to payment authorisation, fraud checks, identity checks, security checks and provider approval.

If payment is refused, declined, reversed, charged back or not completed, we may cancel or suspend the order.

We are not responsible for delays caused by payment authorisation issues, payment provider checks, fraud checks, security checks or incorrect payment information.

If your payment provider, card issuer or bank reverses a payment, raises a chargeback or disputes a payment, we may share relevant order, delivery, account and communication information with the relevant provider, bank, courier, platform, adviser or authority to respond to the dispute.

13.2.     Buy Now Pay Later

If you choose to use Clearpay, Klarna, or another buy now pay later provider, that provider’s own terms, eligibility criteria, fees, payment schedules, privacy policy and customer checks will apply.

You should read the provider’s terms before choosing that payment method.

We are not responsible for any credit decision, late fee, payment schedule, eligibility decision, account action or provider decision made by a buy now pay later provider, except where the law says otherwise.

14.  Delivery, Failed Delivery, Risk and Ownership

14.1.     Delivery Providers and Areas

We may use delivery and logistics providers including:

a.     Royal Mail;

b.    Parcelforce;

c.     Evri;

d.    FedEx

e.     DHL; or

f.      DPD.

The courier used for your order may depend on destination, product type, parcel weight, parcel size, order value, delivery method, service availability and operational requirements.

We deliver to the locations shown on our website or at checkout. We may not deliver to all areas, countries, postcodes, PO boxes, parcel lockers or restricted addresses.

14.2.     Delivery Times and Address

Delivery times are estimates unless we clearly state that a delivery date is guaranteed.

Delivery may be delayed by courier issues, stock availability, weather, customs, security checks, strikes, public holidays, high demand, technical issues, payment checks or events outside our reasonable control.

You are responsible for providing a complete and accurate delivery address.

We are not responsible for failed or delayed delivery caused by incorrect, incomplete or inaccessible delivery information provided by you.

14.3.     Failed Delivery, Lost Parcels And Damaged Parcels

If delivery fails because you are unavailable, you refuse delivery, you do not collect the parcel, or the delivery information is incorrect or incomplete, the parcel may be returned to us.

Where a parcel is returned to us due to failed delivery caused by incorrect information, refusal, non-collection or customer unavailability, we may:

a.     refund the product price, less any delivery or return costs we are legally entitled to deduct;

b.    ask you to pay a further delivery charge for re-delivery; or

c.     cancel the order if re-delivery is not possible.

This does not affect your statutory rights where the issue is caused by us or by a courier acting on our behalf.

If your parcel is lost, damaged or delayed, please contact us as soon as possible at support@emporentia.com.

We may need to investigate with the courier. We may ask for photographs, videos, packaging, tracking details, delivery information or other evidence to help resolve the issue.

14.4.     Risk and Ownership

The products become your responsibility when they are delivered to you or to a person identified by you to receive them.

Ownership of the products passes to you when we have received full payment and the products have been delivered, unless the law provides otherwise.

15.  International Orders, Customs And Restrictions

If international delivery is available, additional delivery times, customs procedures, import duties, taxes, restrictions and charges may apply.

You are responsible for any customs duties, taxes, import charges or local fees payable in the destination country unless we clearly state otherwise.

Some products may be restricted or prohibited in certain countries or by certain couriers. This may include perfumes, liquids, aerosols, batteries, beauty products, chemicals or other regulated goods.

We may cancel or restrict orders where delivery would breach courier rules, import rules, export rules, product safety rules, platform rules or other legal requirements.

16.  Cancellation, Returns And Refunds

16.1.     Consumer Cancellation Rights

If you are a UK consumer buying online, you normally have the right to cancel your order within 14 days without giving a reason.

For goods, the cancellation period usually ends 14 days after the day you, or someone you nominate, receives the goods.

If your order is delivered in multiple parcels, the cancellation period usually ends 14 days after the day you receive the final parcel.

After telling us that you wish to cancel, you normally have a further 14 days to return the goods to us, unless an exception applies.

To cancel an order, you must tell us clearly by email at  support@emporentia.com.

Your cancellation email should include:

a. your full name;

b. order number;

c. email address used for the order;

d. product details; and

e. confirmation that you wish to cancel.

16.2.     Returning Cancelled Goods

If you cancel after the goods have been dispatched or delivered, you must return the goods to us.

Unless the goods are faulty, damaged, incorrectly supplied or we agree otherwise, you are responsible for the cost of returning goods following cancellation.

You must return the goods without undue delay and no later than 14 days after telling us that you wish to cancel, unless an exception applies.

You must take reasonable care of the goods while they are in your possession.

You should return goods using suitable packaging and a reliable delivery method. We recommend keeping proof of postage or tracking.

16.3.     Refunds After Cancellation

Where you validly cancel your order, we will refund the price paid for the goods and the standard delivery charge, if applicable.

If you chose a more expensive delivery option than our standard delivery option, such as express, next-day, nominated-day or premium delivery, we are only required to refund the cost of the standard delivery option.

We do not refund additional delivery upgrades, premium delivery charges or special delivery charges above the standard cost, unless required by law.

Unless the goods are faulty, damaged, incorrectly supplied or we agree otherwise, you are responsible for the cost of returning goods following cancellation.

We may reduce your refund if the value of the goods has been reduced because you handled them more than was necessary to check their nature, characteristics and functioning.

We may withhold the refund until we have received the goods back or you have provided evidence that you have returned them.

Refunds will normally be made to the original payment method used for the order.

Refund times may vary depending on your bank, card issuer, payment provider or buy now pay later provider.

16.4.     Exceptions To Cancellation Rights

Your right to cancel may not apply to certain goods, including:

a. sealed goods that are not suitable for return for health protection or hygiene reasons if they have been unsealed after delivery;

b. goods made to your specification or personalised for you;

c. goods that are liable to deteriorate or expire rapidly;

d. sealed audio, video or software products once unsealed, where applicable; and

e. any other goods excluded from cancellation rights by law.

For hygiene, health and safety reasons, this may include certain opened, unsealed or used perfumes, fragrance products, cosmetics, beauty products, personal care products and similar items where they are not suitable for return due to health protection or hygiene reasons.

This does not affect your rights if goods are faulty, damaged, not as described or incorrectly supplied.

16.5.     Faulty, Damaged, Incorrect or Not as Described Goods

If your product is faulty, damaged, not as described or incorrectly supplied, please contact us as soon as possible at support@emporentia.com.

Depending on the circumstances, you may be entitled to a refund, repair, replacement, price reduction or other remedy under consumer law.

We may ask for photographs, videos, packaging, batch information or other evidence to help investigate the issue.

Your statutory rights are not affected.

16.6.     Other Returns, Refunds and Exchanges

Our Returns and Refunds Policy explain how to return products, when refunds are available and what conditions apply.

Unless the product is faulty, damaged, incorrectly supplied or your statutory rights apply, returned goods should be:

a.     unused;

b.    unopened where hygiene or safety seals apply;

c.     in original packaging where reasonably possible;

d.    with tags, labels, seals and accessories intact; and

e.     returned with any free gifts, bundles or promotional items supplied with the product.

We may inspect returned goods before issuing a refund or exchange.

We may refuse a refund, reduce a refund or return the goods to you where the product has been excessively handled, damaged, opened or unsealed in a way that affects hygiene or safety, is missing parts, or is not returned in a condition that complies with our Returns and Refunds Policy, unless your statutory rights apply.

Your statutory rights are not affected.

This permission may continue after you remove the content where the content has already been used, shared or published, unless the law requires otherwise.

You give us permission to use the name, display name, username or social media handle submitted with the content where reasonably connected with that content.

You can ask us to stop using your social media content by contacting us at support@emporentia.com, but this may not affect uses already made before we receive and process your request.

If you buy our products through Amazon, eBay or TikTok Shop, the relevant platform’s own terms, policies, delivery processes, returns processes, payment terms and dispute procedures may apply.

We are not responsible for platform decisions, account restrictions, payment holds, platform fees, platform refunds, platform dispute outcomes or platform technical issues outside our reasonable control.

Where a platform requires communication through its messaging system, we may only be able to assist you through that platform.
